In the present general conditions the terms "we" and "our" refer to "In a Box Sàrl", and the term "you" means the customer.
Conditions of Acknowledgement
The customer acknowledges having read, during the ordering process, the conditions stated on the screen and accepts them without reserve. The present conditions of use govern the contractual relationship between "In a Box Sàrl" and the customer, both parties accepting them without reserve.
A simple and secured option to settle your purchase with a credit card. We accept MasterCard, VISA and American Express. Data transfer and payment validation proceed via Datatrans. For more discretion, your credit card statement will read "In a Box Sarl".
PostFinance (PostFinance Card or E-Finance) - Switzerland only
With a private PostFinance account you can pay conveniently, securely and free of charge. The amount is debited directly from your postal account.
30 days invoice with SwissBilling - Switzerland only
SwissBilling is a service that allows you to pay your order by invoice.
This payment method is available for orders up to CHF 2'000.00 (Swiss francs). Your shipping and billing addresses must be identical. For legal reasons, oders paid by invoice will be handed over against signature.
You may choose to receive your invoice by e-mail or mail.
If payment by SwissBilling is refused, the reasons may vary: insolvency or financial problems, unknown address, credit limit overdrawn, unpaid bills, etc. It is possible for you to settle the situation by contacting SwissBilling.
PayPal - Switzerland only
PayPal, the trusted leader in online payments, enables buyers to send their payments very easily online. PayPal helps protect your credit card information with industry-leading security and fraud prevention systems. When using PayPal, your financial information is never shared with the merchant. TWINT - Switzerland only
A full subsidiary of PostFinance AG, TWINT is a digital wallet that works with a smartphone (iOS or Android). TWINT does not need a credit or debit card and works with any post office or bank account and independently of the telecom provider. It works much like a traditional wallet: first you fill it with cash, then you spend the cash.

Shipping & Deliveries
Shipping to Switzerland and Liechtenstein
Free delivery on all orders in Switzerland and Liechtenstein.
All orders are shipped with PostPac Priority. The customer can choose whether the parcel should be handed over against signature or not. The customer automatically receives a tracking number in order to follow up the delivery. "In a Box Sàrl" will in no case assume the responsibility in the event of a lost or stolen parcel.
Express shipping is available at an extra cost. Express orders are shipped with the Swiss-Express "Moon" service from the Swiss Post. Parcels are delivered by 9 a.m. the morning following the dispatch, from Tuesday to Saturday.
Shipping to other countries
Packages are sent by UPS Express (delivery time: generally 2 to 3 working days from expedition).
Orders sent outside of Switzerland must have a value over CHF 170.00.
The cost for postage and packaging is CHF 29.90 for orders shipped to these countries: Andorra, Austria, Belgium, Denmark, Finland, Metropolitan France, Germany, Ireland, Italy, Luxemburg, Monaco, the Netherlands, Portugal, Spain, Sweden.
The cost for postage and packaging is CHF 59.90 for orders shipped to those countries: Bulgaria, Canada, Croatia, Czech Republic, Cyprus, Estonia, Faroe Islands, Gibraltar, Greece, Guernsey, Hungary, Iceland, Isle of Man, Jersey, Latvia, Lithuania, Malta, Mexico, Norway, Poland, Romania, San Marino, Slovakia, Slovenia, Turkey, the United States of America.
Orders outside of Switzerland are shipped excluding VAT. You will be subjected to the VAT of your country, along with customs duties, at the border.
Pickup at the warehouse
You can choose to pick up your order at our warehouse in Sion (Valais, Switzerland). When placing your order, choose "Pickup at our warehouse" as the delivery mode. On the next page, you can choose to pay with a credit card, PostFinance, invoice, or to pay cash when you pick your order up. Please note that cash payment in Swiss Francs (CHF) is the only option at our warehouse. Credit card, PostFinance and invoice payment are only available online.

Discretion & Confidentiality
We take special care that our deliveries are discrete (wrapped in plain cardboard boxes or envelopes, no mention of KissKiss.ch). Sender's name will be "In a Box Sàrl". The goods together with the delivery note aren't visible, which enables total discretion.
All personal information will be dealt with confidentially and will never be disclosed to third parties.
Your postal address will not be used for marketing purposes.
ProductsPhotographs and/or pictorial representations of products on sale on KissKiss.ch do not form any part of a contract with "In a Box Sàrl". Product colours shown on KissKiss.ch may vary depending on computer settings, etc… Technical information and links are given for information only. Technical specifications and/or contents of the delivered package may vary from the supplier's data or that shown on the Internet.
PricesThe price billed to customers is the price indicated on the order confirmation on which appears shipping taxes and possible discounts. The prices indicated on the order confirmation are definite, even if there are variations between the order date and delivery date of the goods. If an error should occur with a price of a product, "In a Box Sàrl" reserves the right to correct this error and will offer the customer the right to cancel the order should this occur.
The Swiss VAT is included on prices shown in Swiss Francs (CHF). For deliveries to countries other than Switzerland our deliveries are based on the prices shown in Swiss Francs "HT" (without VAT). In the case of deliveries abroad we do therefore not invoice VAT taxes, but in the event that the shipment is checked at customs it will be subject to the VAT rules of the importing country where VAT may become due.
OrderA firm order is made when you press "Confirm Order" on the confirmation page. By ordering, you are making a firm offer to purchase the selected products. We reserve the right to accept or refuse this offer. "In a Box Sàrl" confirms acceptance of the order to the customer, to the e-mail address given by the customer during registration. This confirmation is effective once the customer receives an e-mail from KissKiss.ch indicating that the order is now "Processing" or "Shipped". This e-mail forms thereby a sales contract between you and "In a Box Sàrl". "In a Box Sàrl" reserves the right to cancel any orders of customers with which payment matters of a previous order exist. If errors are given in customer's shipping information, "In a Box Sàrl" will not be responsible for non-delivery of order caused by events outside of its control.
Orders under CHF 30.00 (Swiss francs) are subject to an additional charge of CHF 5.90 (Swiss francs) (minimum order charge).
Vouchers, discount coupons and other offers may not be combined in any way.
By ordering, you certify being aged 18 or over.
Delivery TimeFor products in stock "In a Box Sàrl" ensures delivery within 24 to 48 hours. If the goods aren't in stock at order, the delivery time is determined depending on availability at the distributor/manufacturer. In general, when products aren't in stock we foresee 3 to 7 days delivery time. We indicate availability or estimated delivery time given by distributor(s)/manufacturer(s). This indicated time is for information only and is not guaranteed. The customer can ask for an indicative timescale for the order by e-mail.
In a Box Sàrl cannot be held responsible for any possible delay in delivery resulting from an error or delay by the delivery service provider (Swiss Post, UPS or DHL). A delay in delivery resulting from an error or delay on the part of the delivery service provider does not entitle you to any compensation or reimbursement and does not entitle you to cancel an order free of charge.
Right of Ownership"In a Box Sàrl" retains ownership of all delivered merchandise until full payment is made.
Damage During Delivery or Delivery ErrorsAny transport damages (e.g. damaged packaging) must be announced immediately to the transporters upon delivery; otherwise the customer accepts full responsibility for any damage to the packaging or to the goods.
Any merchandise delivered by mistake or any additional goods received must be returned immediately, or at the latest 7 days after receipt. In case of non return, the goods will be invoiced.
The Right to Cancel the Order"In a Box Sàrl" allows a 14 calendar day period from delivery of the goods during which the goods may be returned, provided that the goods are unused, unwrapped, undamaged and in the original packaging (with intact safety stickers, not unstuck/torn/cut).
For any return of goods or cancellation of an order, administrative charges apply. These charges amount to 10% of the sales price of the product(s) returned. This fee covers administrative and logistical costs. Shipping costs and any return costs are also at the customer's expense.
The right of withdrawal does not apply to contracts concerning the supply of products abroad (deliveries made outside Switzerland) as well as to all products in the "Lingerie" category and all cosmetic-type products (lubricants, creams, cleansers, etc.).
Before sending anything back, the customer must make a return request (see below).
ReturnsFor any returns related to delivery errors, defective product, etc. a request for return is mandatory. All requests for returns must be made by e-mail: [email protected].
Defective products and products under warranty are replaced by the same product. If that particular product is no longer available, a credit note or a similar product is offered to the client.
In all cases, the return costs remain the responsibility of the customer.
WarrantyElectrical and electronic products proposed on KissKiss.ch are covered by a 2 year warranty from the date of delivery. All other products are not covered by any warranty. In the event of a defective product being repaired or exchanged, an extension of the warranty or renewal of the warranty period is excluded.
Our ResponsibilityThe present "Conditions of use" determine all our obligations and responsibility.
We are not bound by any other warranty, condition or other provision except those expressly stated in this contract.
Any warranty, obligation or other provision concerning the products or services that may be implied or incorporated into this Agreement by law, case law or otherwise (including without limitation any implied condition as to the quality, fitness for purpose of any and all due diligence) are expressly excluded by this provision. In particular, "In a Box Sàrl" is not responsible for guaranteeing that the products are suitable for the purpose for which they are intended.
Our liability under this contract shall be commenced or for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect loss or damage or consequential damages of any nature whatsoever resulting from or caused by tort (including negligence), breach of contract or otherwise. Our total liability for any breach of contract or otherwise (including negligence) or any other cause shall in no case exceed the amount that you are liable for the goods or services in question.
"In a Box Sàrl" cannot be held responsible for any loss or damage you may suffer as a result of any delay in "In a Box Sàrl" meeting its obligations or its breach of any or all of our obligations under the contract, since that such delay or failure is due to circumstances outside our control. In case of delay, we will perform our obligations as soon as possible.
"In a Box Sàrl" cannot be held liable for damages of any kind, whether tangible or intangible, which could result from a malfunction or improper use of the product, sold. It is the same for any changes resulting from product manufacturers. The liability of "In a Box Sàrl" will never, in whatsoever event, be greater than the value of the order and cannot be blamed for simple errors or omissions that may occur despite all precautions taken in the presentation of products.
